InvestArc is a Web & Application (hereinafter referred to as an “app”) developed by InvestArc Fintech Solutions Private Limited, a company incorporated under the Companies Act, 1956 hereinafter referred to as InvestArc. We value the trust you place in us & respect your privacy. Hence, we maintain the highest standards for secure transactions and user information privacy. Please read the following statement to learn about our information gathering and dissemination practices.
 

By downloading/using/accessing the InvestArc Web & application as defined for business and/or personal use, you (“User”) indicate that you understand, agree and consent to this privacy policy. You hereby provide your unconditional consent or agreements to the InvestArc Entities as provided under the information technology act, 2000 and the rules and regulations made under therein for accessing any of the InvestArc platform.
 

This privacy policy is a legally binding contract between You (“User”) and the InvestArc Entities (collectively referred as “InvestArc Entities” and it’s Group / Associates / Subsidiaries, “We”, “Us”). The terms of this privacy policy will be effective upon your registration on InvestArc Platform (as defined below) and will govern the relationship between you and the InvestArc Entities for your use of the InvestArc Platforms. This Privacy Policy shall be read together with the respective terms of use or other terms and conditions of the respective InvestArc’s product offering on InvestArc platform. This document is published and shall be construed in accordance with the provisions of the information technology (reasonable security practices and procedures and sensitive personal data or information) rules, 2011 under the information technology act, 2000; that require publishing of the privacy policy for collection, use, storage, transfer/ disclose of personal information including sensitive personal information. This privacy policy does not require any physical, electronic or digital signature.

By login on web or downloading app you agree to be bound by the terms and conditions of this Privacy Policy. As this Privacy Policy enables us to provide you a secure and wholesome experience and Privacy Policy forms part and parcel of the Terms of Use and other terms on the App (Terms of Use), we will not be able to register you, if you are not in agreement with these terms. By mere use of the Web & App or having access to any InvestArc Platforms or InvestArc Services, you expressly consent to our use and disclosure of your personal information in accordance with this Privacy Policy.
 

Definitions:
 

“InvestArc platforms” - Refers to any platform owned/subscribed/used by InvestArc Fintech Solutions Private Limited or any other InvestArc Entities not limited to websites, mobile applications, devices, URLs/links, notifications, chatbot, or any other communication medium used by by InvestArc Entities to provide its services to its Users.
 

"InvestArc Service" shall include all services extended / to be extended by InvestArc and InvestArc entity as a group including but not limited to Pre-Paid Instruments, Payment Aggregator, Payment Gateway, Insurance, Mutual Fund, Gold sale & purchase, Bill payment & recharge, switch including others.
 

“Cookies” - “Cookies are small files placed on your device hard-drive/storage that assist us in providing our services. We offer certain features that are only available through the use of a "cookie". "Session Cookies" - These are temporary files that are automatically deleted from your device hard-drive/storage at the end of a session.
 

“Business Partners” – Shall refer to any individual, group of individuals defined under law with whom InvestArc or InvestArc Entities have a contractual relationship not limited to Merchants, Advertisers, Deal partners, Financial institutions.
 

“Service Providers” – Refers to any individual, group of individuals defined under law whose services are used by InvestArc or InvestArc Entities in order to provide the intended services to You through InvestArc platforms.

Amendment of Privacy Policy

Our Privacy Policy is subject to change at any time without notice and the same shall be updated and available within InvestArc App and on its website at www.Investarc.in from time to time. Though every effort would be made to keep you informed of the changes, if any, to the policy, you are kindly advised to review the policy periodically. Any changes to the Policy will become effective upon posting of the revised Policy on the Internet, accessible through InvestArc Platform.

Scope & Applicability

This Privacy Policy is applicable to all users of InvestArc including merchants, customers, business partners whether registered or non-registered accessing, offering, selling or purchasing products or services on the website, mobile applications, links, notifications, short messaging services, or any other communication medium used or owned by InvestArc (InvestArc platforms).
 

InvestArc has permitted its InvestArc entities to use the InvestArc websites, applications and other communication platforms (InvestArc platforms) for their InvestArc Services. This Privacy Policy is also applicable to InvestArc’s Group/Affiliate/Subsidiary Companies defined as InvestArc Entities who provide their products/ services on the InvestArc’s website and mobile applications or control InvestArc directly or indirectly.

We collect, process, store, transfer and record Your data and information while You visit any of InvestArc platforms or avail InvestArc Services. This Privacy Policy is provided to familiarize You with;

By providing Us Your Information or by making use of the InvestArc Services provided by the InvestArc App or InvestArc platforms, You hereby consent to the collection, storage, processing, disclosure and/or transfer of any or all of Your Personal Information (as defined below), Sensitive Personal Information (as defined below) and Non-Personal Information (as defined below) by InvestArc Entities, as specified under this Privacy Policy.
 

Our primary goal in doing so is to provide you a safe, efficient, smooth and customized experience. This allows us to provide services and features that most likely meet your needs, and to customize our Website/Application to make your experience safer and easier. More importantly, while doing so we collect personal information from you that we consider necessary for achieving this purpose.

  • Physical, physiological and mental health condition
  • Sexual orientation
  • Medical records and history
  • Biometric information
  • Any information relating to the above points shared by You.
  • Any of the information received by InvestArc Entities for processing, stored or processed under lawful contract otherwise.

Provided that, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as Sensitive Personal Information and may be regarded as Personal Information.

• Non-Personal Information- We and our Service Providers may collect non-personal data while you access InvestArc platforms via URL, smartphones or any other mobile devices. This      information shall not identify “you” as a person.
  • The devices and identification numbers of devices used by you to access InvestArc       platforms.
  • I.P address and information related to the I.P address.
  • Your geographic location, cookies stored on your browser/devices and behavior on InvestArc platforms.
  • The operating system of your device, browser, browsing behavior and any other data as permitted to be stored by mobile app stores.
  • OTP sent to you by your issuer bank or InvestArc platforms exclusively to carry out transactions on InvestArc platforms.
  • Your messages on message boards, chats or any other message/feedback areas shared on InvestArc Platforms and social media.

Information may be collected in various ways and formats during the course of your visit or access to InvestArc Platforms by way of -

• Visiting InvestArc platforms.
• Registering on InvestArc platforms as an “user” or “merchant” or any other relationship that may be governed by terms and conditions listed on InvestArc platforms.
• Transacting or attempting to transact on InvestArc platforms.
• Accessing, links, e-mails, notifications sent or owned by InvestArc platforms.
• Otherwise dealing with any of the “InvestArc Entities”

We and our Service Providers or Business Partners may also collect information made publicly available through other third-party platforms, through online or offline databases that are otherwise legitimately obtained and are subject to the third party's terms of use and/or privacy statement.
 

We may automatically track certain information about you based upon your behavior on our App. We use this information to do internal research on our users' demographics, interests, and behavior to better understand, protect and serve our users. This information is compiled and analyzed on an aggregated basis.
 

We and our Service Providers use data collection tools such as cookies/similar, etc. on certain pages of the app to help analyze our app page flow, measure promotional effectiveness, and promote trust and safety. We offer certain features that are only available through the use of a "cookie".

InvestArc aspires to deliver a safe, efficient, smooth and customized experience. We aspire to provide services and features that most likely meet your needs, and to customize our Website/Application to make your experience safer and easier. InvestArc may collect, use, store and transfer your Personal Information including Sensitive Personal Information and Non-personal information for the following purposes
 

• Verification of your identity, access, privileges assigned in order to provide the services you request, or we intend to offer.
• To resolve disputes; troubleshoot problems; help promote a safe service; collect money; measure consumer interest in our products and services,
• To inform you about online and offline offers, products, services, and updates; customize your experience and improving your experience while using the application by      presenting advertising, products and offers tailored to you.
• To detect and protect us against error, fraud and other criminal activity; enforce our terms and conditions; and as otherwise described to you at the time of collection.
• To analyze demographic and profile data about our users' activity on our app.
• To help diagnose problems with our server, and to administer our app. Your IP address is also used to help identify you and to gather broad demographic information.
• Responding to the judicial process and providing information to law enforcement agencies or any government agency in connection with a query/investigation on matters as permitted by law.
• Allow third parties to contact with You for products and services availed/requested by You on InvestArc platforms or third-party links.
• To identify security breaches and attacks, investigating, preventing and taking action on      illegal or suspected fraud or money laundering activities and conducting forensic audits as part of internal or external audit or investigation by any of the InvestArc Entities or government agencies located within India or outside Indian Jurisdictions.
• Sharing, disclosing and transfer of data in case of any major event such as merger, acquisition, sale or transfer of assets in case of any Force Majeure event to any other      InvestArc Entity or third party.
• For data processing, statistical or risk analysis and for analytics and review for improvement of the product/services.
• For designing and marketing, InvestArc products/services and its affiliates products/services.
• For conducting risk management.

To the extent we use your personal information to market to you, we will provide you the ability to opt-out of such uses.
 

We identify and use your IP address to help diagnose problems with our server, and to administer our app. Your IP address is also used to help identify you and to gather broad demographic information.
 

We will occasionally ask you to complete optional online surveys. These surveys may ask you for contact information and demographic information (like zip code, age, or income level). We use this data to tailor your experience at our app, providing you with content that we think you might be interested in and to display content according to your preferences.

Information Storage and Sharing

Your Personal Information and Sensitive Personal Information shall be stored in electronic form with exceptions, wherein the data is required to be maintained in physical form in information and data centers.
 

Your data may be collected, stored and processed in countries other than Indian Jurisdictions by Us or our Service Providers as permitted under applicable laws.
 

• We shall share personal information with our Business Partners/Service Providers and InvestArc entities for purposes defined under this Privacy Policy.
• We shall share personally identifiable information / Sensitive Personal Information provided by you to Business Partners/Service Providers and InvestArc Entities in the      course of making transactions.
• Your data shall be shared with Service Providers that InvestArc work with for services not limited to communication, marketing, data and information storage, transmission, security, analytics, fraud detection, risk assessment, academics.
• Your data may be shared with the internal investigation department within InvestArc Entities or agencies appointed by InvestArc entities for investigation purposes located within or outside Indian Jurisdictions.
• We may disclose personal information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court      orders, or other legal process. We may disclose personal information to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to: enforce our  Terms or Privacy Policy; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the      rights, property or personal safety of our users or the general public.
• We and our affiliates will share / sell some or all of your personal information with another business entity should we (or our assets) plan to merge with, or be  acquired by that business entity, or re-organization, amalgamation, restructuring of business. Should such a transaction occur that other business entity (or the new combined entity) will be required to follow this privacy policy with respect to Your personal information.
• We have affiliates around the world. To the extent permitted by law, we may share information with them for specific purposes not limited to investigation or forensics.

Retention period -We retain your information for as long as needed or permitted considering the purpose(s) for which it was obtained and will retain this information till such period as prescribed under applicable law.

Safeguarding your information

InvestArc has deployed technical and physical security measures to safeguard user’s Personal Information and Sensitive Personal Information and undergo strict internal and external reviews to ensure appropriate information security encryption or controls are placed for both data in motion and data at rest within our network and servers respectively.
 

We have provided multiple levels of security to safeguard your App by Login/Logout option. We have preventive controls implemented to ensure you use InvestArc App on your device and same login cannot be used on different device without any additional authentication/OTP. Please do not share your InvestArc login, password and OTP details with anybody.
 

When you choose to make payment on InvestArc platforms via cards, some part of your card information is stored in compliance with Payment Card Industry Data Security Standard.
 

All Sensitive Personal Information and some part of your Personal Information shall be retained under applicable laws. Personal Information/Non-Personal Information may be retained even after termination of relationship between you and InvestArc Entities.

Information Disclosures

Links to Other Platforms - Our app links to other platforms may collect personally identifiable information about you. InvestArc or InvestArc Entities are not responsible for the privacy practices or the content of those linked platforms. Links to third-party advertisements, websites or any other electronic communication service may be provided on InvestArc platforms, which are operated by third parties and are not controlled by, or affiliated to, or associated with, the InvestArc Entities. InvestArc Entities shall not control the data shared by you on such links and shall be governed by respective third party’s Privacy Policy. You are required to review the third party’s Privacy Policy for handling of your data before sharing your data on such links/websites/apps.
 

Information Breach - While We shall take all reasonable and appropriate processes and precautions to secure any Personal Information//Sensitive Personal Information which We hold about You, You acknowledge that no data transmission over the internet is fully secure, so we cannot provide any assurance or warrant the security of any information you submit to us.
 

Review your Personal Information & Sensitive Personal Information - You may review your Personal Information and Sensitive Personal Information shared by You by logging info InvestArc platforms using your secure login credentials and may notify Us in case of any change.
 

Indemnity - You shall indemnify and hold harmless the InvestArc Entities, their officers, directors, contractors or agents and any third parties relying on the Information provided by You for any losses, including all claims, damages, liabilities, deficiencies, assessments, interest, awards, settlements, penalties, fines, costs or expenses, suffered, incurred, sustained by, or imposed on the InvestArc Entities, as a result of, arising out of, with respect to, in connection with or by reason of a breach or non-performance of any of the terms, conditions, representations or warranties contained in this Privacy Policy by You.
 

Force Majeure - A Force Majeure Event shall mean any event that is beyond the reasonable control of the InvestArc and shall include but not limited to war, riots, fire, flood, acts of God, explosion, strikes, lockouts, slowdowns, prolonged shortage of energy supplies, Pandemic, computer hacking, unauthorized access to computer data and storage devices, computer crashes ,acts of state or governmental action prohibiting or impeding InvestArc Entities from performing its respective obligations under the contract.
 

Jurisdiction - This Privacy Policy is governed by and shall be construed in accordance with the laws of Republic of India and any disputes arising out of or in connection with this Agreement shall be subject to jurisdiction of the Courts of Bangalore, India.
 

You further agree that such collection, use, storage, disclosure and/or transfer of Your Information shall not cause any loss to any other person. The information so provided by You may be shared to InvestArc Entities and the third-party service provided on a need-to-know basis.
 

This disclosure may be required for us to provide you access to our Services, to comply with our legal obligations, to enforce our User Agreement, to facilitate our marketing and advertising activities, or to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our Services. We do not disclose your personal information to third parties for their marketing and advertising purposes

User Discretion and Choice/Opt-Out

You agree and acknowledge that your Personal Information, Personal Sensitive Information and Non-Personal Information out of your free will. You further agree to all the provisions of this Privacy Policy and authorize us to manage the data shared by your or collected by us to be used according to this Privacy Policy.
 

We provide all users with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications from us on behalf of our partners, and from us in general, after setting up an account. If you want to remove your contact information from all InvestArc lists and newsletters, please click on the unsubscribe button on the emailers.
 

By using the InvestArc platforms and/ or by providing your information, you consent to the collection and use of the information you disclose on the app in accordance with this Privacy Policy, including but not limited to Your consent for sharing your information as per this privacy policy. You also grant permission to obtain information from your mobile device by way of using our app including contacts on your device in order to provide a better payment experience.
